I am very frustrated today. Below is a link to a case in El Paso, where I used to be a prosecutor. I know the judge personally, and although I knew he was not a good person, I am floored by what he did in this case. The mother of a young child went out drinking with her young child, came home drunk, left the child in the car seat, and went home to bed. The child was found dead in the carseat 10 hours later! She was charged with negligent homicide. Wow. How could he possibly justify this? And why is it allowed?
It's stupid what some judges will get away with. One in my locale got crap reviews from the judicial board, plus parties on both sides of her trials (like, as a rating of 65% when most judges were high-90's). And *still* the populace didn't unseat her in the election. Sad.

And *still* the populace didn't unseat her in the election. Sad. Umm....As far as blaming the populous, I am among-st the few who does their due diligence before voting. There is zero info. out there about judges. I just vote against every time. Sounds like more corruption of power that goes un-checked.

And *still* the populace didn't unseat her in the election. Sad. Unfortunately, a judge can direct an acquittal when there was no evidence to support any element of the offense. Most judges are VERY hesitant to do this because it takes the decision away from the jury. However, this particular judge honestly thinks he is smarter than anyone. This was a pure travesty and he should be kicked out of office for it. However, in that community, he will continue to be re-elected.

In my jurisdiction, the voters are provided with the feedback scores from both sides of their cases (is the judge competent, professional, ethical, deals fairly, etc.), as well as their score from judicial review panel who recommend whether they should be removed. The info is there, but voters need to read it. :-( In the case flashjohn cites, it sure seems like the case should have been dismissed in a way that allowed charges to be re-filed with better preparation, not a verdict which lets her go free after killing a child under her care. Very sad. Justice did not get its day in court.

In many communities, and this one in particular, the populace just votes straight ticket. He had an opponent a few years ago, but because she was not of the predominant race in the city, she had no chance. Frankly, I am so glad to be out of there.

Very sad. Justice did not get its day in court. That is the problem. If a jury has been seated, that means that jeopardy has attached. If the prosecutor had dismissed the case after that point, the defendant would have been protected by double jeopardy. In this case, the judge made the call. It is very sad that this child died and the mother will get away scot free.

That is truly a tragedy and a travesty. My W is a CASA, the horror stories she brings home make my war stories pale in comparison. The stuff people get away with is just amazing.
