I do not need consent whether it’s implied or not. Nobody has control of my body. . . Funny, this is exactly what the refusers say about their reason to refuse us..

I would say no to both. But I didn't give consent when he chose celibacy so I didn't feel I needed consent to be sexually and emotionally fulfilled.

I did have the talk with my W, so she is aware of my need for sex. I explicitly said if I didn't get it from her I would go elsewhere. 6 years later I am still going elsewhere. Our kids are grown with families of their own. We live in a no fault state - so the 50/50 rule applies. Right now I don't care which way it goes - but I ain't askin' her for nothin' at this point.

As soon as I told my refuser I was meeting my needs elsewhere she filed for divorce. She said, "it's the only way I can live with integrity." I asked her how she kept her integrity by never wanting to have sex with me, but never got an answer.
I do believe it is implied consent, but, the law is archaic and punative, so know what paths it may take.
